1. DLT Software Solutions are the exclusive owners of all Softwares and are being marked under their familiar trade name "DLT". The licensee accepts DLT Software Solutions having exclusive proprietary rights over all products marketed under name having "DLT" as prefix including "DLT online", "DLT full Text Editions" and "DLT case Searcher". The licensee further accepts the licensor to have ownership rights over all/any part of designing, colour scheme, get up and other special features giving it peculiarity in its presentation including the copyright over all its head notes, part thereof and further upon the presentation of full text. Thus the licensee/user shall not be permitted any re-production, replication, re-trivial, transmission of any of the information for use to a third person and shall remain strictly confines for its own/personal use.

2. In case any of the above products is provided with the security system other than with the Dongal (Activation Key), the same would be utilized/operated for a single user computer system only. It would be prohibited for the licensee to permit or allow it to be permitted any kind of its transmission either by deployment of any electronic device or otherwise.

3. Special Package for Institutions

Terms of Payment

The Licensor on payment of full non-refundable license fee shall grant non-transferable and non-exclusive license to the licensee/user to enjoy in the manner prescribed hereunder only. The user of the Data information search engine or other part of the grant including hardware product CD-ROM/DVD, Dongal (Activation Key) etc.

The licensee/user subject to such further non-refundable additional payment will be entitled to up-dates as released by the licensor from time to time in terms of the entitlement of the licensee.

It is the licensee however, to bear all taxes, dues, fee if levied after the date of grant of such license/permission.

In case of the default in payment of the license fee/additional fee, the licensor shall have the sole discretion to take recourse to the following measures :

(a) to stop further use of software/product by any means (internal or external procedures) or recover/repossess software/product; and

(b) to cease further updating through CD/DVD/internal till the default or dispute is resolved, and

(c) to invoke all legal remedies available under existing laws.

Duty of Care (the user)

(a) The licensee shall not claim as a right the replacement of tampered/damaged hardware such as CD-ROM, DVD ROM or the Dongal (Activation Key). The decision of the licensor in this regard shall be absolute and final. It remains the duty of the licensee thus to keep all or any of them under good conditions and due care.

(b) As provided above, the hardware such as CD ROM/DVD, Dongal shall remain the exclusive property of the licensor. In the event of termination of license, the licensee shall forthwith return each of the above item in good condition unless licensor permits otherwise. The failure of the licensee to meet this obligation shall entitle the licensor to enforce discontinuation of their in its use or destruction whichever found convenient and expedient, in this regard.

Duty of Care (Service Provider)

Licensor has taken every minute care to ensure accuracy, correctness and authenticity in Database. Instead, any mistake/correction/omission/error crept in inadvertently, the Licensor or its Agents will not be liable in any manner for the inconvenience arising therefrom or for any resultant or consequential loss.

Security

(a) The DLT website account information is pass word protected for users' privacy and security.

(b) In certain areas DLT uses SSL-encryption to protect data transmissions.

(c) In the event of any policy change, the notification shall be posted on the home page of the site.

Intellectual Property Rights

(a) Nothing enlisted herein shall be construed as conferring any license or right, except as expressly provided in the terms and conditions of use of the web site of the DLT, by estoppel or otherwise, under any of the intellectual property rights.

(b) It is implied that the user agrees the protection of the site by copyrights, trademarks, patents and designs. Any rights not expressly granted herein are reserved.

(c) DLT trade marks shall not be used in connection with any product or service not provided by DLT, in any manner that is likely to cause confusion among subscribers and visitors or in the manner that discredits the good will of DLT.

Copyrights

i) Content or information provided by DLT through its web sites is protected by Copyright Act, 1957. It contains logos, information, software, photographs, clips, graphics, links and various materials that are protected by IPRs or third party contents givers.

ii) Certain data made available by DLT are the property of content providers and are identified as such. DLT is licensed to store, catalogue, rearrange (to make it user friendly) and distribute the information to its subscribers.

Limitation on Use

(a) Content of the web service are only for personal and non-commercial use.

(b) All such information the representation of which is made on the site are mere compilations and do not contain any piece of legal advice.

(c) Licensee shall not be entitled to tamper, disintegrate, re-compile, modify, re-arrange/disturb the sequence of the parameters and extracts from data base by employment of any device or mechanism capable in any manner in this behalf. In case so found, it will be available to the licensor to forfeit all/any of the above such devices forthwith besides initiating such measures for imposition and recovery of further penalties/damages.

Limitation on Liability

i) DLT Software Solutions under no circumstances shall be liable to any user for (a) loss, injury or damages resulting from use (b) does not represent that the downloaded information is completely error-free and accurate or the services provided are free of viruses and other related harmful components.

ii) DLT Software Solutions claims exemption from any such liability though due care has been taken while drafting and compiling the data-base to optimize its reliability.

iii) The Licensor or its Agents will not be liable for any failure to perform its obligations, due to force majeure which includes acts beyond control such as power or equipment failure, Labour unrest, accidents, act of God, statutory body, Directions of Courts/Forum/Tribunals etc.

Termination

In the event of termination of the subscription

(a) the terms regarding the payment of money due to DLT, the warranties and indemnities and the subsequent restrictions on subscribers rights of use of data base, shall survive the expiry of the subscription.

(b) any material obtained from the site or subsequent distribution of material or incorporation into any of the various forms, medium or technology now known shall be destroyed upon termination.

Offline Help

DLT Software Solutions does not guarantee that

(a) the services provided meets the exact requirement of user

(b) the service provided will be error-free, secure and timely

(c) the service provided will be accurate and reliable

(d) the quality of information , services and other related material will meet users expectations

Thus DLT makes no representation regarding suitability, reliability, availability and timeliness of services provided by DLT on-line.

Cookies

A cookie is a small data in the form of text file often including anonymous unique identifier stored on the hard drive of users computer. It is sent to the user's browser from provider's computer. On users permission each web site can send its own cookie but to protect user privacy user's browser permits the access of cookie already sent.

DLT uses its own cookies for various purposes namely, "sign in" , keep track of users preferences, display most appropriate ads., assist merchants in e-shopping and estimates total audience size and traffics.

However, user may choose to accept or refuse the cookie by changing the settings of its browser, though this is done to make the service speedy and user friendly.
